Timothy Egnatofs, 15, along with some others, was in the bed of a 1997 Nissan Frontier truck. His neighbor, Frank L. Poston, 36, was the driver. It was Friday evening around 10 pm and Poston and some teens were coming from Bartlett Lake where they had spent the day camping and fishing.
Poston was driving too fast on Cave Creek when he lost control of the truck. He swerved on the road near Desert Mountain Parkway. He crashed the truck and as a result Egnatofs and some of the other passengers were thrown from the truck bed.
When police arrived at the accident site, Egnatofs was dead and the others were seriously injured. There was another car that was accompanying Poston and witnessed the crash. Some of them reported to the police that four of the six teenagers smoked marijuana.
A 17 -year-old had to be taken by air to the local hospital where he is in serious condition but getting better.
Police arrested Poston and charged him for manslaughter, aggravated assault and endangerment. Poston was not seriously injured in the accident and neither was his 18 -year-old passenger.
A DUI squad officer spoke with Poston. He saw that Poston showed signs that he may have been drinking so took some breath tests. The results of these tests have not been released yet.
